The Legislation and Trusts Committee advises Council on the appropriate form for draft Statutes and Regulations of Council and oversees the University’s stewardship of endowments and trusts.
I. Membership
Four persons appointed by Council (at least three to be members of Council)
One member nominated by the Committee of Convocation
The President of the Academic Board
Senior Vice-Principal or nominee
University Secretary
One member nominated by the chairperson, in consultation with the President of the Student Union
Up to three additional members with expertise in legal drafting or trusts co-opted annually by the Committee
One member nominated by the chairperson, in consultation with the President of the Postgraduate Association
The Chairperson is appointed by Council from the members appointed by Council. The Committee elects its own Vice-Chairperson.
N.B. The Senior Vice-Principal’s nominee is the Vice-Principal and General Counsel.
II. Terms of Reference
The Legislation and Trusts Committee is to consider:-
- all proposals for Statutes and Regulations, and any Standing Resolutions of Council referred by the Vice-Chancellor or Council, in the light of the policy which they are intended to implement and the requirements of the Melbourne University Act 1958 and to certify to Council that any such proposals are in a form proper to be made by Council.
- The Committee provides advice to Council on any comments on legislation made by the Committee of Convocation.
- (a) Subject to sub-paragraph (b), the Committee oversees and monitors, and advises Council on, all matters concerning the administration and performance of trusts and other funds involving fiduciary obligations as reflected in University Regulations.
(b) The Vice-Chancellor is responsible for the proper administration and performance of all trusts and other funds involving fiduciary obligations as reflected in University Regulations, including certifying to Council annually whether or not in his opinion, these obligations are being performed in accordance with the law and in proper fulfilment of their terms.
- The Committee is to consider and report to Council on such other matters relating to University legislation, trusts and endowments as the Council or the Vice-Chancellor may from time-to-time refer to it.
III. Delegations
The Legislation and Trusts Committee holds no delegations from Council.
