Public Liability & Personal Indemnity
Public Liability -Policy No: ULMEL 08
Students are covered under the University's Public Liability Insurance
- in the event that they are held to be legally liable ( eg: negligence )
- for causing personal injury or property damage ( to a third party )
- caused by an occurrence in connection with their University course related activities ( eg: study, research, field studies, internships, approved work experience. )
How to notify a liability claim
To ensure that the respective rights and interests of the University of Melbourne are appropriately taken into account, certain procedures should be followed.
- Notify the Insurance Office: ins-office@unimelb.edu.au as soon as practical that an incident has occurred.
- Please clearly identify your Faculty / School or Department and attach any relevant documents in relation to the incident, or circumstances involved. Do not delay reporting the loss.
- Do not enter into any communications regarding liability or responsibility for the incident or particular circumstances with the other parties involved, whether verbally or in writing.
- It is the sole responsibility of the University's Insurer to accept or reject liability.
- Any agreement entered into with the other party without the approval of the University's insurer could prejudice the University's claim.
- Any Summons, Writ or other legal demand must immediately be directed to the Insurance Manager, Insurance Office.
- The Police must be notified if a crime has been committed. Apart from assisting the police in the conduct of their enquiries, extreme caution must be exercised in making statements to persons who may not be acting for the University's insurer.
The University’s Professional Indemnity insurance policy incorporates 3 principal areas of cover: Professional Indemnity, Medical Practice and Clinical Trials. UoM Students have been included as Insured Persons under this policy.
The University’s Professional Indemnity insurance – “Insuring Clause” states that:
"The Insurer will indemnify the University against
- civil liability for compensation and claimant's costs and expenses
- in respect of any Claim or Claims first made against the University
- and notified to the Insurer during the Period of Insurance
- resulting from the conduct of the Professional Services."
The following condition of cover under this insurance policy requires that UoM Students engaged in approved health care related activities must only act under direct supervision.
"The definition of Insured is extended to include any natural person who is a past and/or present student of the University or entities specified in the Schedule, but only:
(a) in his or her capacity as such; and
(b) whilst providing the Professional Services under the direct supervision of a suitably qualified practitioner."
