Unpublished Works

Unpublished works are literary, artistic, dramatic or musical works that have never been made available to the public, i.e. commercially or non-commercially published, or made available on the Internet (anything made available on the web is considered to be published and is subject to copyright). Unpublished works are subject to copyright. Copyright lasts indefinitely in unpublished works until the work is published. Once an unpublished work is published, copyright lasts 70 years after the death of the author or the date of publication.

Unpublished works can be reproduced or communicated in part or in full for educational purposes. Refer to the Guidelines for using copyright material for educational purposes.

It may also be possible to copy unpublished works for research & study under the Fair Dealing.

There is also a special provision for libraries to copy unpublished material under certain circumstances. For more information, contact the Copyright Office.
