Separately Published
Special provisions apply to works in anthologies or compilations that have not been separately published and are not available as individual standalone works. If an item has not been separately published then it may be reproduced under the Part VB Statutory Licence or Fair Dealing. Limits apply to the the amount and number of works that can be copied from compilations or anthologies, however if the work has not been separately published, you may copy it in full or in part.
This provision only applies to literary, dramatic, musical and artistic works. It does not include films, sound recordings or journal/periodical articles.
Finding out whether or not a work has been separately published can be difficult and will depend on the type of material, (e.g. short story or image,) the subject matter as well as when and where it was published. There are various catalogues and bibliographies available that can help you search. Searching on Google may also indicate whether an item has been seperately published or not. The Copyright Office or Library Staff may also be able to help. Remember to keep a record of what sources you consulted and the results of your search.
Artistic works such as photographs and images are often published as part of another work, e.g. a textbook or in a newspaper. Again, whether or not the image has been published separately is important in determining whether or not you can copy or communicate the work for education purposes. To find out whether an image has been published separately, try on-line image banks. If the work was published in a newspaper or textbook, contact the publisher. However, most charts & graphs published in textbooks are rarely published separately.
