Recitals
- By section 18 of the Melbourne University Act 1958 power is conferred on the University to make and alter statutes for the affiliation to or connection with the University of any college or educational establishment subject to certain conditions set out in that section.
- The Victorian College of Agriculture and Horticulture ("the College"), a company limited by guarantee, was incorporated under the provisions of the Corporations Law on 13 September 1991 and its objects include the following-
- to provide post-secondary education programs and experience for the preparation and continuing development of persons for roles in agriculture, horticulture and dairy technology;
- to conduct or support the conduct of appropriate research in investigation of and development of programs in agriculture, horticulture and dairy technology and publish or help to publish the results thereof and otherwise encourage the application of the results thereof;
- to engage in the business of primary production (including nursery production), the marketing of agricultural, horticultural and dairy technology products and services and in the processing or manufacture of these products to the extent that the Council considers necessary or expedient for the purpose of providing education and training;
- to co-operate with the Department of Agriculture's research industry and district services;
- to relate to the overall Government policies, goals and priorities for agriculture and horticulture in Victoria;
- to provide post-secondary education in such other fields of knowledge and expertise as the Council, after consultation with the appropriate authorities, may determine;
- to engage in any business to the extent that Council considers necessary or expedient for the purpose of providing education and training;
- to control and operate the campuses known as Dookie, Glenormiston, Longerenong, Burnley, McMillan and Gilbert Chandler;
- to provide such services to education outside Victoria including overseas countries as the Council may deem appropriate after consultation with appropriate State and Federal agencies;
- to provide facilities or services for study, research or education; and
- to undertake research, development, consultancy or other services for commercial organisations, public bodies and individuals.
- By an agreement dated 13 November 1992 the College and the University have agreed to the affiliation of the College to the University and to the establishment within the College of a school of the University.
- The College has consented to the provisions of this statute.
Affiliation of the College
9.37.1 (1) The College is an educational establishment affiliated to the University for the purposes of-
- promoting the teaching and supervision of undergraduate and postgraduate students of the University and providing facilities therefor;
- promoting and encouraging appropriate research amongst students and providing facilities therefor;
- promoting a co-operative effort between the staff of the College and the staff of the University towards teaching and research in areas of common interest; and
- promoting and encouraging appropriate research between members of staff of the College and members of staff of the University and providing facilities therefor.
(2) There is a school of the University called the "School of the Victorian College of Agriculture and Horticulture" ("the school") located within the College, the head of which must be appointed by the Council of the University on the advice of the College.
(3) For a transitional period until an appropriate faculty structure has been implemented by the University to accommodate the school, a standing committee of the Board called VCAH Programs Committee is to liaise between the school and the Board to enable direct academic supervision of school award courses.
(4) Nothing in this statute requires the University to bear any part of the cost of the provision of facilities for teaching or research work in the College or the College to bear any part of the cost of the provision of facilities for teaching or research work in the University.
(5) This affiliation ceases on the termination of the agreement referred to in recital 3.
