Recitals
- By section 18 of the Melbourne University Act 1958 power is conferred on the University to make and alter statutes for the affiliation to or connection with the University of any college or educational establishment subject to certain conditions set out in that section.
- The Melbourne Business School Limited ("the School"), a company limited by guarantee, was incorporated under the provisions of the Companies (Victoria) Code on 30 June 1989 and its objects include-
- undertaking the education of university graduates, undergraduates and others in management studies;
- conducting post-experience courses for practising managers;
- conducting postgraduate research programmes into management and related areas, and promoting, licensing, developing and applying the results of research activities;
- offering consulting services in management and related areas;
- conducting seminars and conferences on issues and problems of management;
- preparing, publishing, distributing or licensing ideas and material on management;
- establishing the physical facilities necessary to the carrying out of the above; and
- undertaking research, development, consultancy or other services for commercial organisations, public bodies or individuals.
- By agreement dated 7 August 1989 the University and the School agreed to the affiliation of the School to the University and to the establishment within the School of an academic department of the University. By agreement dated 12 May 1994 the University and the School agreed to the change of name of the School to Melbourne Business School and on 1 August 1994 the Australian Securities Commission formally re-named The Graduate School of Management Limited as Melbourne Business School Limited.
- The School has consented to the provisions of this statute.
Affiliation of the School
9.28.1 (1) The School is an educational establishment affiliated to the University for the purposes of-
- promoting the teaching and supervision of undergraduate and postgraduate students of the University and providing facilities therefor;
- promoting and encouraging appropriate research amongst such students and providing facilities therefor;
- promoting a co-operative effort between the staff of the School and the staff of the University towards teaching and research in areas of common interest; and
- promoting and encouraging appropriate research between members of staff of the School and members of staff of the University and providing facilities therefor.
(2) There is a department of the University ("the department") located within the School and-
- the director of studies of the School is the head of the department;
- the deputy director of studies of the School is the deputy head of the department; and
- both must be employed in part by the University and in part by the School, and their responsibilities for academic standards and student progress must be in accordance with the terms of employment set by the University.
(3) Nothing in this statute requires the University to bear any part of the cost of the provision of facilities for teaching or research work in the School nor the School to bear any part of the cost of the provision of facilities for teaching or research work in the University.
(4) This affiliation ceases on the termination of the agreement referred to in recital 3.
