Recitals
- By section 18 of the Melbourne University Act1958 power is conferred on the University to make and alter statutes for the affiliation to or connection with the University of any college or educational establishment subject to certain conditions set out in that section.
- The Victorian Institute of Marine Sciences ("the Institute") was established by the Victorian Institute of Marine Sciences Act1974 as a body corporate, its objects being-
- to provide facilities for and foster, carry on and support scientific research and technological development in all branches of learning concerning or touching upon marine sciences, including but without limiting the generality of that expression, the sea, the sea-bed, sea shores, and the resources and inhabitants thereof and mankind's relationship with the use of the sea;
- to advance knowledge of the marine sciences and to advance the practical application of such knowledge to commerce and industry;
- to provide facilities for instruction, demonstration, and training in subjects relating to the sea and its resources;
- to make known when and as the Council considers advisable by printed publication or otherwise any information or advice concerning any matter relating to the purposes of the Institute and, with a view thereto, to acquire, set up, maintain, print, publish, and circulate magazines and journals, circulars, pamphlets, or other literary or scientific works as the Council considers to be in any way beneficial to the Institute or to the public or any section thereof;
- to provide facilities for research and a library and library facilities and to maintain and from time to time extend such facilities and library; and
- to conduct or join in conducting such centres for the display and demonstration of marine and maritime exhibits as the Council determines.
- By an agreement dated 29 November 1983 the Institute and the University have agreed to the affiliation of the Institute to the University.
- The Institute has consented to the provisions of this statute.
Affiliation of the Institute
9.23.1 (1) The Institute is an educational establishment affiliated to the University for the purposes of-
- promoting the teaching of undergraduate students and postgraduate students of the University and providing facilities therefor;
- promoting and encouraging appropriate research amongst such students and providing facilities therefor; and
- promoting a co-operative effort between Institute staff and University staff towards teaching and research in areas of common interest.
(2) The affiliation ceases on the termination for any reason of the agreement referred to in recital 3.
