Statute 5.1 - TThe Faculties and Graduate Schools

Establishment of faculties

5.1.1 1 The Council must, by regulation, determine the name, number and composition of faculties, and the regulation must be published in accordance with section 1 of Statute 1.4.
  2 Where any faculty which is not a graduate school uses the word ‘school’ in its name, the provisions of this Statute 5.1 (and not Statute 6.1) apply to such faculty.

Establishment of graduate schools

5.1.2 1 The Council must, by regulation-
  1. determine the name and number of graduate schools;
  2. identify which of those graduate schools are established as faculties; and
  3. determine the composition of those graduate schools established as faculties.
  2 Any regulation under section 5.1.2(1) must be published in accordance with section 1 of Statute 1.4.
  3 Except in relation to sections 5.1.1 and 5.1.2, a reference in this Statute to a faculty is to be construed as including a reference to a graduate school identified as a faculty pursuant to section 5.1.2(1)(b).
  4 In the case of a graduate school not identified as a faculty, the provisions of the remainder of this statute do not apply to it, and the graduate school is to be treated as a school established within a faculty pursuant to Statute 6.1 so that the provisions of Statute 6.1 apply to it as if it were established pursuant to that Statute.

Appointment of teachers and research fellows

5.1.3 On the recommendation of a faculty, the Council may appoint as members of the faculty for one year-

  1. any member of the academic staff;
  2. any teacher in an affiliated institution; and
  3. any research fellow attached to a department of the faculty whose duties include teaching.

Appointment of persons with expert knowledge

5.1.4 1 In consultation with a relevant faculty, the Council may appoint as members of the faculty persons who possess expert knowledge and who are not members of the academic staff.
  2 An appointment under this section is for three years.

Appointment of member of committee of convocation

5.1.5 1 On the recommendation of the committee of convocation, the Council may appoint to a faculty, other than the faculty of Medicine, Dentistry and Health Sciences, for one year a member of the committee who is a representative of the graduates of the faculty.

On the recommendation of the committee of convocation, the Council may appoint to the faculty of Medicine, Dentistry and Health Sciences for one year two members of the committee-

  1. one of whom is a representative of the medical graduates of the University, and
  2. the other of whom is a representative of graduates of dental science or dentistry of the University.
  3 For the purposes of sub-sections (1) and (2) the president of convocation is eligible to be appointed to represent the graduates of the faculty or faculties of which he or she is a graduate.

Appointment of students1

5.1.6 1 On the recommendation of a faculty, the Council may appoint students as members of the faculty for one year.
  2 If a faculty has more than ten graduate students it must recommend from amongst the students enrolled in a course or subject which pertains to the faculty or which has been assigned to the faculty for administrative purposes, the appointment of at least-
  1. one undergraduate student; and
  2. one graduate student.
  3 If the faculty has less than ten graduate students it is not required to recommend the appointment of any graduate student to the faculty but must recommend the appointment of at least two undergraduate students.
  4 Students recommended for appointment to a faculty are to be selected by any method approved by the faculty.
  5 A person appointed under this section ceases to be a member of the faculty if he or she ceases to be a student enrolled in a course or subject which pertains to the faculty or which has been assigned to the faculty for administrative purposes.

Powers and duties of faculties

5.1.7 In addition to any powers and duties conferred upon faculties by the Act, by any other statute or by regulation, each faculty must-

  1. report to the Council or the Board on any matter referred to it by the Council or the Board;
  2. deal with all applications for information and other correspondence on any relevant matter brought before it by the dean or by the academic registrar; and
  3. advise the Council or the Board, either directly or through the provost as appropriate, on relevant matters pertaining to administration, studies within its scope and the curriculum for each of the degrees and diplomas pertaining to that faculty, and also for any University degrees and diplomas which have been assigned to the faculty for administrative purposes.
  4. administer subject to the direction of the provost and of the Board any University courses pertaining to it or which have been assigned to the faculty for administrative purposes.

Faculty committees

5.1.8 (1) Subject to the Act, the statutes and the regulations a faculty may appoint committees to conduct the day-to-day management of the faculty.

(2) With the consent of the Council, a faculty may delegate any of its powers and duties to a committee appointed by it.

(3) Every delegation under sub-section (2) is revocable by resolution of the faculty and no such delegation prevents the exercise or discharge by the faculty of any of its powers, authorities, duties or functions.

(4) Where the Council considers it to be appropriate it may, by regulation, establish, for a specific purpose, a faculty committee.

Proxies

5.1.9 (1) Subject to any regulation of the Council a member of a faculty, other than a student member, who is unable to attend a meeting of the faculty may nominate in writing to the dean any other member of the same department of the faculty to act in his or her place at the meeting.

(2) A student appointed as a member of a faculty who is unable to attend a meeting of the faculty may nominate in writing to the dean any other student in the same faculty to act in his or her place at the meeting.

(3) A person nominated under this section is to be regarded as a member of the faculty for the purposes only of the meeting for which the person has been nominated.

Quorum for faculty meetings

5.1.10 The quorum for any meeting of a faculty is ten members or one fifth of the membership whichever is the greater.
