Statute 4.1 - Academic Board

Establishment of the Board

4.1.1 (1) The Board is hereby declared to have been established from the commencement date of the Act, as provided in this statute and regulations made thereunder.
  (2) Council must by regulation determine the composition of the Board, and may by regulation determine aspects of its meeting procedures.  Any regulation which deals with the composition and procedures of the Board may be changed only after consultation with the Board
  (3) The Board may make to Council any recommendation about the academic affairs of the University, and in particular may make to Council any recommendations as to studies and disciplines in the University
  (4) Subject to any statutes or regulations of the University, the Board may regulate its own proceedings
  (5) Nothing in this statute affects resolutions of the Board made under Melbourne University Act 1958 or statutes and regulations of the University thereunder

Duties and powers of the Board

4.1.2 (1) The Board is responsible to Council for-
  1. the supervision and development of all academic activities of the University, including the maintenance of high standards in teaching and research;
  2. determination of all matters related to courses and subjects, admission and enrolment of students, and assessment and admission to degrees, save for those matters expressly reserved by legislation as requiring Council decision
  3. development and maintenance of policies and rules governing academic matters;
  4. approving the terms of and awarding prizes, scholarships and other forms of recognition governing academic matters and
  5. communication with the academic community through the faculties and other academic units
  (2) Consistent with the generality of sub-section (1), and having regard in particular to the responsibilities vested in the Board as reflected therein and in other University statutes, the Board must provide Council with any information or reports required by Council, including -
  1. reporting systematically to Council on all matters for which the Board is responsible to Council as set out in subsection (1), and otherwise on the Board’s contribution towards the achievement by the University of any strategic plans approved by Council from time to time; and
  2. supplying Council with adequate, appropriate and timely information on matters within the responsibility of the Board which then enables Council and its committees to conduct enquiries, to make assessments and judgments, and to gain assurance that the decisions and actions of the Board are appropriate to the achievement by the University of any strategic plans approved by Council from time to time, and otherwise to the objects and values of the University;
  (3) Consistent with the generality of sub-section (1), the Board must also -
  1. unless otherwise provided in a statute, act as the final appeal body within the University in all matters relating to students and their grievances against decisions made by University bodies or by individual officers, or in such matters relating to persons who have ceased to be students because of the decision complained of;
  2. consider any reports submitted to it by any faculty or other body;
  3. exercise the powers and perform the duties of a faculty for all courses not pertaining to or assigned for administrative purposes to any faculty; and
  4. exercise any other powers or perform any other duties conferred or imposed on the Board by any other statute or regulation or by any resolution of Council.
  (4) Without restricting the power of Council to make regulations on any matters affecting the University, the Board may make regulations on any of the matters described in this section 4.1.2, such regulations to become effective on endorsement by Council.

Election of officeholders

4.1.3 (1) The Board must elect annually three of its members to be president, vice-president and deputy vice-president respectively for the ensuing calendar year
  (2) A person elected under the preceding sub-section is eligible for election as president, vice-president or deputy vice-president in any subsequent year.

Casual vacancies

4.1.4 (1) A member of the Board, including any member holding office under section 4.1.3, may be elected to fill a casual vacancy occurring in the office of president, vice-president or deputy vice-president.
  (2) A member elected under sub-section (1) holds office for the remainder of the calendar year in which the casual vacancy occurs.

Delegation of powers

4.1.5 (1) Subject to this section, the Board may by resolution delegate any of its powers and duties, including the hearing of appeals under section 4.1.2 (3) (a), to any member of the Board or to any committee appointed by the Board.
  (2) The Board may not delegate-
  1. the power to make University regulations
  2. the duty to provide such information or reports as may be required by Council under section 4.1.2(2); or
  3. the power of delegation conferred upon it by this section.

Publication of Board resolutions

4.1.6 The university secretary must make available to all students, in a form approved by the Board accessible throughout the University, all Board resolutions containing information which directly affects students
