Statute 1.1 - Preliminary

Citation

1.1.1 These statutes are cited as The University of Melbourne Statutes.

Commencement

1.1.2 (1) These statutes come into operation immediately prior to the coming into effect of Part 2 of the University Acts (Amendment) Act 1994.
(2) All previous statutes, and regulations allowed under the Melbourne University Act 1958 prior to 1 January 1989 which have not been previously repealed, are hereby repealed.

Interpretation

1.1.3 (1) In these statutes unless a contrary intention appears-

'academic registrar' means the vice-principal and academic registrar appointed under Statute 2.6;

'academic year' means-

  1. the period commencing on and including the Monday falling on or closest to the first day of March of each calendar year and concluding at the end of the annual examination period; or
  2. any other period determined by the Council;

'the Act' means the Melbourne University Act 1958: where any provision in these statutes is inconsistent with a provision in the Act the provision in the Act prevails;

'acting officer' means a person duly appointed or elected to act in the place of an office-holder for the time being;

'affiliated institution' means a college, educational, commercial, cultural, sporting or other institution, organisation or body affiliated to the University under section 18 of the Act and Chapter 9 of the statutes;

'appropriate department' means the department responsible for giving lectures in a particular subject or, if lectures are not given in the subject, the department to which a thesis or work pertains;

'appropriate faculty' means the faculty to which a course or subject pertains or has been assigned for administrative purposes or, if a course or subject does not pertain, or has not been assigned for administrative purposes to a faculty, the Board;

'assessment' means assessment in accordance with Chapter 12 of these statutes;

'Board' means the Academic Board established under section 2.8 of the Act and constituted under Statute 4.1;

'body' or 'body of the University' means a body of the University other than the Council which is constituted under the Act or any statute or regulation and includes a faculty, a department, a school, a board or a committee;

'Calendar' means The University of Melbourne Calendar;

'Chancellor' means the Chancellor of the University elected under section 11 of the Act;

'chief financial officer' means the chief financial officer and vice-principal appointed under Statute 2.6;

'class list' means a list compiled and submitted in accordance with the directions of the Board specifying the order of merit of students who have achieved honours in a course or subject;

'committee of convocation' means the committee constituted under section 23 of the Act;

'Council' means the Council of the University constituted under section 5 of the Act;

'dean' means the dean of a faculty appointed or elected under section 29 of the Act and Statute 5.3;

'department' in relation to-

  1. an academic department means a department established under Chapter 6 of these statutes;
  2. any other department means a department established under Chapter 8 of these statutes;

'deputy chancellor' means a deputy chancellor elected under section 11 of the Act and Statute 2.3;

'deputy vice-chancellor' means a deputy vice-chancellor appointed under section 15 of the Act and Statute 2.5;

'details of subjects' means the details of subjects published by the academic registrar under section 15 of Statute 5.4;

'diploma' includes all awards granted by the University other than degrees;

'division' means an organisational grouping declared by regulation to be a division;'

'election officer' means a person nominated by the registrar to assist the registrar in the conduct of an election under the Act or the statutes;

'elector' means a person who is eligible to vote in an election held under the Act or the statutes;

'faculty' means a faculty established under Statute 5.1, or a graduate school established as a faculty under Statute 5.1;

'full-time' in relation to a member of staff of the University means-

  1. a member of staff who is employed on full-time duties; and
  2. a member of staff whose duties are defined to include some of the duties of a member of staff who is employed on full-time duties or who is expressly employed for half-time or more;

'general purposes of the University', 'general educational purposes' and similar expressions mean, without limiting the generality of the same, courses of study, employment of staff, research, the provision of amenities and services for students and staff and such other purposes as Council may determine from time to time;

graduate school’ means a graduate school established under Statute 5.1;

head of university services’ means the head of university services and vice-principal appointed under Statute 2.6;

'higher degree' means a degree of master or doctor or a graduate diploma or postgraduate diploma;

'investment pool' means an investment pool established under section 38 of the Act;

'Library' means The University of Melbourne Library;

'MUSUL’ means the MU Student Union Limited;

'office-holder' means a person duly appointed or elected to hold any office under the Act or the statutes;

'postgraduate diploma' includes a graduate diploma for the purposes of section 3(2)(b) of the Act;

'prescribed member of staff' means-

  1. a professor or a dean of a faculty; or
  2. a member of the academic staff whose sole or principal employment is in connection with his or her duties as such; or
  3. a member of the staff of the University other than academic staff, whose sole or principal employment is in connection with his or her duties as such;

'pro-vice-chancellor' means a pro-vice-chancellor appointed under section 15 of the Act;

provost’ means a deputy vice-chancellor appointed as the provost under Statute 2.5;

'recognised institution or body' means an institution or body recognised by the University under section 17 (1) (r) of the Act;

'regulation' means a regulation made in accordance with the provisions of section 17 of the Act;

'relevant electorate' means the relevant person or group of persons empowered by section 5 of the Act to elect a member of Council;

'resolution' means a determination of the Council, the Board or a faculty made under the Act or the statutes or regulations;

'returning officer' means the university secretary;

school’ means any academic unit established as a school of the University pursuant to Statute 6.1.6 and includes a graduate school that is not identified, by regulation, as a faculty;”

'semester' means a period of time determined by statute;

'senior vice-principal' means the senior vice-principal appointed under section 1 of Statute 2.6;

'standing resolution' means a resolution declared to be a standing resolution made by the Council, the Board or a faculty which is consistent with the powers of that body and which is not inconsistent with the statutes and regulations;

'statute' means a statute of the University made under the Act;

'UMPA' means the University of Melbourne Postgraduate Association Incorporated;

‘UMSU’ means the UMSU Incorporated

'University' means The University of Melbourne;

'university secretary' means the university secretary appointed under Statute 2.6;

'vice-chancellor' means the vice-chancellor and principal appointed under section 15 of the Act;

'vice-principals' means the senior vice-principal and the vice-principals appointed under section 2 of Statute 2.6;

'Year' means the courses or subjects which must be completed by a student in any academic year, or as otherwise provided by Statute 5.4, to meet the requirements specified by the Council for the granting of a degree or diploma;

  1. The statutes of this chapter apply in the interpretation of all statutes and regulations.
  2. Unless a contrary intention appears, the Interpretation of Legislation Act 1984 applies to the interpretation of all statutes.
  3. In any reference to a statute by numbers, the number before the first period refers to the chapter, the number before the second period refers to the statute and the number immediately after the second period refers to the section.
  4. A schedule appended to a statute forms part of the statute to which it is appended.
  5. Footnotes to a statute do not form part of the statute.
