R6.201 - THE E & D ROGOWSKI SCHOLARSHIPS

Recitals-

A. Ms. Danuta Rogowski, late of 20 Martin Street, Brighton, who died on 6 August, 1997, made the following provision in her will dated 9 April, 1997-

"I GIVE AND BEQUEATH the sum of ONE HUNDRED THOUSAND DOLLARS ($100,000.00) ("the said Sum") to THE UNIVERSITY OF MELBOURNE to establish scholarships for students enrolled or to be enrolled in the Faculty of Music to study either the Cello or the Saxophone ("the Instruments") in accordance with the following provisions:

i. The University shall invest the said sum in its name in any investments permitted by law for the investment of trust funds and shall apply the net income in each year in perpetuity for the promotion and encouragement of students of the instruments or either of them.

ii. The said sum and the investments representing it shall be called "The E & D ROGOWSKI TRUST FUND" ("the Trust Fund").

iii. The University shall apply the net income each year in the Trust Fund in establishing and maintaining scholarships to be called "The E & D ROGOWSKI SCHOLARSHIPS" for students of the Instruments to enable such students to undertake the Bachelor of music course at the Faculty and to enable such students to complete the Bachelor of Music course.

iv. The Scholarships will be awarded in each year to a student or students of the instruments to be chosen by the Selection Committee of the Faculty with the approval of the Dean of the Faculty who shall have the absolute discretion to decide the number of Scholarships to be awarded in each year and the amount of the income to be expended in each year and any income not expended for awarding the Scholarships in any year may be applied in a subsequent year for the awarding of such Scholarships.

v. The Selection Committee will take into account the scholastic ability of proposed students and give preference to students suffering financial hardship".

B. The University has received the sum of $100,000 in satisfaction of the bequest.

It is hereby provided as follows-

1. The sum of $100,000 and any accumulations and additions to the sum forms a fund called "The E & D Rogowski Scholarships" ("the fund") and the fund must be paid into an investment pool and remain there until the Council directs otherwise.

2. Subject to section 5, the net annual income of the fund is to be used to establish and maintain scholarships, each to be called "The E & D Rogowski Scholarship" ("the scholarships") for students enrolled in the degree of bachelor of Music in the faculty of Music ("the faculty") whose main instrument is either the cello or the saxophone.

3. The scholarships are to be awarded annually by the Council on the recommendation of a committee to be established in the faculty and the committee, in selecting the scholars, must take into account scholastic ability and must give preference, in cases of equal scholastic ability, to those students who are suffering financial hardship.

4. The dean of the faculty must determine each year how many scholarships are to be offered and their value.

5. Any unexpended income in any year may be applied to the award of the scholarships in a subsequent year.
