R6.99 — Dieul-Kurzweil Scholarship

Recitals-
- Photimport Proprietary Limited of Collingwood gave to the University the sum of £1,000 to endow a scholarship to be known as the "Dieul-Kurzweil Scholarship" which is to be awarded to a student who is preparing for the degree of Master of Science in Physics and is in need of financial help to pursue the course, the award to be made in general not more frequently than once in every three years.
- The founder authorized the investment of the sum in securities authorized by the laws of the Commonwealth of Australia or any of its States or Territories for the investment of trust funds or in debentures of or preference or ordinary shares or stock units in any company or in any other investment as the Council from time to time thinks fit.
- In 2006, the University determined that the scholarship should be open to MSc and PhD students rather than only MSc students as ‘There are now too few candidates enrolling for the degree MSc in Physics since most postgraduate students enrol directly as PhD candidates.’ Accordingly a cy près application was made to the Attorney-General for Victoria (‘the Attorney-General’) pursuant to section 4 of the Charities Act 1978 (Vic.) (‘the Act’).
- On 31 October 2006, the Attorney-General sanctioned the following scheme pursuant to section 4 of the Act to vary the trust known as The Dieul-Kurzweil Scholarship:
‘the scholarship be awarded to candidates for either the degrees of Master of Science or Doctor of Philosophy in the school of Physics.’
- At 9 April 2008, the amount of the fund was $22,589.67.
It is provided as follows-
- The sum of $ 22,589.67 and any additions and accumulations to the sum forms a fund called the "Dieul-Kurzweil Scholarship" ("the fund") and the fund must be invested in such of the above-mentioned investments as the Council from time to time directs.
- The scholarship is to be awarded to candidates for either the degrees of master of Science or doctor of Philosophy in the school of Physics.
- The scholarship is awarded by the Council on the recommendation of the head of the School of Physics (`the head').
- The scholarship is in general be open for competition trienially but if on any occasion when the scholarship is available for award there is no applicant or no applicant is deemed worthy the scholarship is to be available for award in the succeeding years until it is awarded.
- The value of the scholarship is the net income of the fund in the triennial period preceding the award and the amount of the scholarship must be applied first to the payment to the academic registrar of the scholar's annual fees any balance being payable to the scholar.
- Each applicant must produce evidence of his or her financial circumstances and in making a recommendation for the award of the scholarship the head must take into consideration each applicant's financial circumstances.
- An award is not to be made if in the opinion of the head no applicant is worthy.
