Subject Description

The law of evidence regulates the means by which facts may be proved in litigation. It is obviously concerned, therefore, with promoting accuracy in fact-finding, but in criminal proceedings it also attempts to regulate the relationship between state and citizen and to ensure that the accused receives a `fair trial'. The subject has been divided into the following units: Introduction; adducing evidence; relevance; investigation; the gathering of evidence; investigation: interrogation and confession; hearsay: the exclusionary rule; hearsay: exceptions to the rule; opinion evidence; tendency and coincidence evidence; privilege and immunity; credibility evidence; revision. In first semester a week of classes will be devoted to each of these units; in summer semester a day of classes will usually be devoted to each of these units.

Assessment

Final Exam 3 hours (100%).
