Subject Description

The resolution of disputes with emphasis upon the role of courts and the way in which they regulate the disposition of litigations. The nature and organisation of the legal profession. Admission to the profession. The moral foundations of legal ethics. the ethical responsibilities of the lawyer. the duties owed to the law, the court and the client. Conflicts of interest. Acting for a guilty client. Immunity from suit for negligence in court. The Legal Profession Practice Act 1958. Discipline. Trust Accounts. Access to justice. The role of mediation and negotiation. Contingency fees. The role of the judge.

Assessment

Final exam 1 l/2 hours (50%), 2 Litigation exercises totalling no more than 5000 words (50%), Trust Accounts Exam 1 hour (Pass/Fail).

Students must pass the Trust Accounts examination and achieve an overall result of 50% to satisfactorily complete the subject.

The materials necessary for the litigation exercises will be made available on the Law Faculty's local area computer network.
