730-357 Equity

Subject Description:

An analysis of the principal equitable doctrines and remedies, including the avoidance of unconscientious transactions, undue influence, fiduciary obligations, and personal and proprietary remedies. The second semester will be devoted to a study of the law of trusts. Topics covered will include a study of the rules for creating express trusts, the social functions of trusts, public policy in the law of trusts, charitable trusts, resulting and constructive trusts.

Assessment:

Either Research Essay, not exceeding 6000 words (50%) and a two hour Exam (50%) or a three hour Exam (100%).

Materials will be issued by the Law School.

  • Act, Trustee Act, 1952.
