Subject Description: | This subject is designed to enable students to formulate and conduct research in an area of Chinese law. The subject will first consider research methodologies applicable to the study of Chinese law. It will then examine theoretical issues about the place of law in the Chinese societies of the Peoples Republic of China, Taiwan and Hong Kong. The subject covers traditional Confucian/Legalist approaches to law, Marxist legal theory and the impact of liberal democratic ideologies. The inter-relationship between the legal systems of the PRC, Taiwan and Hong Kong will also be considered. We will discuss re-unification, self-determination and legal harmonisation. We will also explore different approaches to state regulation of the economy. Later topics in the subject will be derived from students research proposals. | |
