Subject Description:

The nature of restrictive trade practices. Outline of the common law of doctrine of restraint of trade. The nature and objectives of the Trade Practices Act 1974 (Cth). The constitutional operation of the TPA. Markets, market power and competition. Mergers and acquisitions. Misuse of market power. Anti-competitive arrangements. Exclusive dealing. Resale price maintenance. Role of Trade Practices Commission and the Trade Practices Tribunal. Authorisation, penalties and remedies.

Assessment:

Either Research Assignment 3000 words (30%) and Final Exam 2 hours (70%) or Final Exam 3 hours (100%).

  • Act, Trade Practices Act, 1974 (Cth).
