732-305 Law of Insolvency

732-202 Corporate Law.

Two 1-hour lectures and a 1-hour tutorial a week

Objectives:

Upon the completion of this subject students should have developed:

  • a sound understanding of the law relating to: bankruptcy, including arrangements with creditors outside bankruptcy;

  • a sound understanding of the law relating to company insolvency;

  • a knowledge of the consequences of insolvency on individuals, partnerships and companies, and on those who manage companies;

  • an appreciation of the way in which the property of bankrupts and insolvent companies is administered, including the rights of secured and unsecured creditors to such property;

  • a knowledge of the policy underlying the law of insolvency and its reform.

Content:

The law relating to bankruptcy, including arrangements with creditors outside bankruptcy. The law relating to company insolvency and matters pertaining to insolvency.

Assessment:

A 2 1/2-hour end-of-semester examination.

A reading list will be provided at the beginning of the subject.
