730-204 Constitutional and Administrative Law

Compulsory Law subject.

Pre/Corequisite: Torts and the Process of Law; History and Philosophy of Law.

Contact: 4 hours per week

Timetable: Both semesters

Objectives:

Students completing this subject should be able to: understand the legal framework within which government in Australia is established and operates; apply the principles of law relating thereto; understand the historical development and the current working of government.

Content:

The nature of public law. British constitutional concepts. Historical development of the Victorian constitution. Models of federalism. Historical development of the Commonwealth constitution. Development of independence. Constitutional amendment. Separation of powers. The judicature. The legislature. The federal financial and economic framework.

The Crown - immunities and privileges. Commonwealth and State administration - organisation, structure and functions; accountability to Parliament. Review of administrative action - background and theory. Judicial review - avenues, grounds and remedies. Administrative review of the administration. The Ombudsman. Freedom of information.

Assessment:

Research Assignment not exceeding 3,000 words (30 per cent) and Final Exam 3 hours (70 per cent).
