R6.57- THE ARTHUR NYULASY PRIZE

Recitals-

  1. Francis Armand Nyulasy, M.D. B.S., late of Melbourne, medical practitioner bequeathed to the University the sum of £1,000 to found a prize or scholarship in memory of his late brother Arthur John Nyulasy who for thirteen years ending February 1924 was senior gynaecologist to the Perth Hospital Western Australia on the following conditions

    1. That the money be invested and that as often and as soon as the accumulated income from the investment thereof shall amount to the sum of £100 such sum shall be devoted to or used for the purpose of providing a Prize or Scholarship for that graduate in Medicine of the University not less than one nor more than three years' standing who shall have proved himself the most competent-

      1. in knowledge of and skill in Operative Gynaecology; or
      2. in Research Work in Gynaecology.


    2. That the prize or scholarship be called 'The Arthur Nyulasy Prize' or 'The Arthur Nyulasy Scholarship'.

  2. It is no longer practicable to give effect to the conditions aforesaid for the reason that in the circumstances of modern medical training it is not possible for a graduate in Medicine to gain sufficient competence in knowledge of and skill in Operative Gynaecology or in research work in Gynaecology within a period of three years following graduation.

  3. The Supreme Court of Victoria on the 11 February, 1966, made an order relating to the terms of the Will and declaring that as it had become impracticable to carry out the trust the University might apply the bequest for the purposes set out in the Will cy pres as if for the words 'of not less than one or more than three years' standing' there were substituted the words 'of not less than one nor more than ten years' standing'.

  4. The sum of £1,000 increased to $26,970 at 31 December 1994.

  5. On 31 October 2002 the Attorney General of Victoria made an Order that-

    'The prize-
    (i) be awarded annually,
    (ii) be the net annual income of the Fund,
    (iii) that the words "obstetrics and gynaecology" be substituted for "gynaecology".'

It is provided as follows-

  1. The sum of $26,970 and any accumulations and additions to the sum forms a fund called the 'Arthur Nyulasy Prize' ('the fund') and the fund must be paid into an investment pool and remain there until the Council directs otherwise.

  2. The value of the prize is the net annual income of the fund.

  3. Competition for the prize is open to graduates in Medicine of the University who are of not less than one nor more than ten years' standing on the date fixed for the lodging of applications.

  4. The prize is open to be awarded annually to the candidate who, by either-

    1. demonstrated knowledge and skill in surgery; or
    2. a thesis or other published research;

      has made the most significant contribution to obstetrics and gynaecology.

  5. The prize is to be awarded by Council on the recommendation of the dean of the faculty of Medicine, Dentistry and Health Sciences who before making any such recommendation must consult the head of the department of Obstetrics and Gynaecology.
